June 10, 2020 – The U.S. Trade Representative (USTR) granted a fifth round of exclusions from Section 301 additional duties for Chinese origin products found on List 4A that currently enter using Harmonized Tariff Schedule (HTS) 9903.88.15.
Two ten-digit HTS were newly excluded, 5210.11.4040 and 5210.11.6020; as well as thirty-two product specific exclusions.
These new exclusions represent 55 separate exclusion requests. They are effective September 1, 2019, through August 31, 2020, and will use HTS number 9903.88.49.
Another notice modified an exclusion description for a List 1, Tranche 7 exclusion for ‘machines for crushing/grinding pills’ of HTS 8479.82.0080, changing the value requirement in the exclusion description from ‘each valued over $20 but not over $35’ to ‘each valued not over $35’. This exclusion enters using HTS 9803.88.14.
Exclusions are available for any product that meets the description, regardless of whether the importer filed an exclusion request.
Refunds for duties previously paid may be recovered if within time constraints. A Post Summary Correction (PSC) is used for unliquidated entries, and a Protest is used for entries liquidated within the past 180 days. Importers should contact their Livingston Service representative to request any applicable PSCs or Protests be filed.
