On January 1, 2021, the United Kingdom and European Union initiated new trading regimes as part of their final separation. The regimes include the EU-UK Trade and Cooperation Agreement (TCA), which removes tariffs on the vast majority of goods traded between the two entities, but also the implementation of new Value-Added Tax accounting, new customs documentation and new regulatory requirements.
The launch of the new trading regimes has resulted in significant disruption, including border delays and incalculable time spent by businesses trying to understand customs requirements to which they had never been exposed previously. Beyond the disruption lies significant risk of non-compliance in preferential-duty claims that could result in fines or penalties and/or retroactive duties. There are opportunities to mitigate the administrative burden of Brexit and to achieve cost savings, but understanding what is required is essential.
