The main objectives of the proposed regulation are:
- Eliminate the exceptions provided for in sections VII and VIII of numeral 10 of Annex 2.4.1, relative to the ease of not having to prove to the customs authority compliance with the corresponding Official Mexican Standards (NOMs), since Over time it has been erroneously considered that if a merchandise is not going to be sold to the public, it should not comply with the Official Mexican Standards of commercial information, when the fundamental objective is to guarantee that the Information necessary regarding the products in order to safeguard the health, physical integrity of people, and the environment.
- The exception provided for in section XV of the aforementioned numeral 10 of Annex 2.4.1, relative to the ease of not having to prove to the customs authority compliance with the corresponding Official Mexican Standards, is eliminated, in order to establish that all the Goods destined to remain in the border region or strip must comply with the labeling in Spanish language, since there is the false belief that because they are in areas near the northern border of the country, there is a command of the English language, and this prevents The users of these areas have full protection in that they have basic minimum information in Spanish for their protection, which is why it is extremely important that all the information requirements that the labels must contain are in Spanish. which will allow the user to know the medical, health, product care, warning and side effects that it may cause, among others.
- Establish electronic controls to the procedures set forth in numeral 6 of Annex 2.4.1, in order to carry out compliance with the Official Mexican Standards of commercial information in national territory, either in a general warehouse authorized for that purpose, or well, in a private address, in order to make the customs operation more efficient, but under a scheme that guarantees compliance with the Official Mexican Standards of commercial information.
