March 23, 2020 – The U.S. Trade Representative (USTR) granted an Eleventh Round of Exclusions from Section 301 additional duties being assessed on imports of Chinese origin products found on List 3, that will use exclusion Harmonized Tariff Schedule (HTS) number 9903.88.43.
All List 3 exclusions are effective September 24, 2018, through August 6, 2020, unless extended.
The eleventh round of exclusions cover 203 separate exclusion requests. The complete HTS number 7002.10.2000 was excluded, and partially excluded were 176 specific product descriptions.
Amendments were also made adding 5 new exclusions to Round Seven, using exclusion HTS 9903.88.37, for HTS 8484.59.6540 for certain ventilation fans for motor vehicles consisting of a 12 V multi speed electric motor drawing 5 A that are:
Non-reversible, with axial fan blade:
- electric keypad and circuit board and wire mesh screen, measuring no more than 36 cm by 36 cm, or
- keypad and circuit board and wire mesh screen, measuring no more than 36 cm by 36 cm, or
- keypad or remote control and circuit board and wire mesh screen, measuring no more than 36 cm by 36 cm, or
- network control system and wire mesh screen, measuring no more than 36 cm by 36 cm, or
Reversible, with axial fan blade, electric keypad and circuit board and wire mesh screen, measuring no more than 36 cm by 36 cm.
In addition, two adjustments were made to Round Eight, using exclusion HTS 9903.88.38, to change from a product specific exclusion description, to the complete 10-digit HTS, for frozen sole and flounder fish fillets classified in HTS 0304.83.5015, and 0304.83.5020.
Refunds for duties previously paid, which are now excluded, may be applied for using a Post Summary Correction (PSC) for unliquidated entries; or a Protest for entries liquidated within the past 180 days.
