July 2020 China Section 301 Update

The U.S. Trade Representative (USTR) was busy modifying former Chinese Section 301 approved exclusions, to include the new July 1, 2020 Harmonized Tariff Schedule (HTS). New HTS added are noted below, by product List.

This notice also modified the tariff noted in the exclusion description, from 8708.99.6890 to 8708.40.7570, for certain exclusions which use exclusion HTS 9903.88.46.

The USTR also extended twelve of 110 exclusions for List 1 Tranche 6, until December 31, 2020.  The extended exclusions will use a new exclusion HTS of 9903.88.52. Ninety-eight exclusions that used exclusion HTS 9823.88.11 expired on July 9, 2020.

In addition, they granted a sixth round of exclusions for 4A that currently enter using HTS 9903.88.15. This includes sixty-one specially prepared product descriptions, under 86 separate exclusion requests.  They will use exclusion HTS 9903.88.51, and expire on September 1, 2020, along with all List 4A exclusions.

The USTR is also accepting applications to extend List 4A exclusions from July 15, 2020 to August 14, 2020, using their public docket.

Exclusions are available for any product that meets the description, regardless of whether the importer filed an exclusion request.

Refunds for duties previously paid may be recovered if within time constraints.  A Post Summary Correction (PSC) is used for unliquidated entries, and a Protest is used for entries liquidated within the past 180 days.  Importers should contact their Livingston Service representative to request any applicable PSCs or Protests be filed.
