Health Canada is notifying interested parties that an updated industry guide for vaping products that are subject to the Canada Consumer Product Safety Act (CCPSA) and Part 2 of the Vaping Products Labelling and Packaging Regulations (VPLPR) is now available.
The new Industry Guide to Vaping Products Subject to the Canada Consumer Product Safety Act replaces the Guidance on Vaping Products not Marketed for a Therapeutic Use, specifically replacing the information provided on the Consumer Chemicals and Containers Regulations, 2001, with the new requirements set out in Part 2 of the VPLPR.
In Canada, vaping products that are not marketed for a therapeutic use are addressed under the Canada Consumer Product Safety Act (CCPSA), the Tobacco and Vaping Products Act (TVPA), and the Vaping Products Labelling and Packaging Regulations (VPLPR).
This guide provides information to industry on the requirements that apply under Part 2 of the VPLPR to vaping products that are manufactured, imported, advertised or sold in Canada. In particular the guide provides information regarding:
- labelling requirements for a list of ingredients
- maximum allowable nicotine concentration
- child-resistant container requirements
- labelling requirements for toxicity information
This guide also provides additional health or safety considerations for vaping products including electrical and mechanical considerations for vaping devices and vaping parts, as well as chemical and microbial considerations for vaping substances.
In addition to the product-specific requirements noted in this guide, it is prohibited to manufacture, import, advertise or sell any consumer product that is a “danger to human health or safety” as defined in the CCPSA (see paragraphs 7(a) and 8(a) of the Act).
This guide published 13 July 2020 is for Manufacturers, importers, distributors and retailers of vaping product and other interested parties who are affected by the regulations.
