Government of Canada initiates expiry review of refined sugar SIMA case

The Canadian International Trade Tribunal (CITT) advised on October 2, 2020, of the initiation of an expiry review of its finding made on October 30, 2015, concerning the dumping of certain refined sugar originating in or exported from the United States, Denmark, Germany, the Netherlands and the United Kingdom and the subsidizing of said goods originating in or exported from the European Union.

Concurrently, on October 5, 2020, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the above finding is likely to result in the continuation or resumption of dumping and subsidizing of the subject goods.

The CBSA will make a determination no later than March 1, 2021, and will issue a Statement of Reasons by March 16, 2021.

For a detailed product description, including exclusions and the applicable tariff classifications of the subject goods, please refer to the Refined Sugar case in the Measures in Force.

As part of its expiry review investigation, the CBSA has forwarded questionnaires to Canadian producers, importers and exporters. Any Canadian producers, importers or exporters who have not received a letter and wish to provide a response to the questionnaire or have additional questions concerning the expiry review are advised to contact:

Laurie Trempe: 613‑954‑7337

Serena Major: 613‑948‑8581

Or by e-mail to: simaregistry-depotlmsi@cbsa-asfc.gc.ca

Responses to all questionnaires are due at the CBSA’s office in Ottawa by November 12, 2020.
