On October 30, 2018, the Canadian International Trade Tribunal (CITT) initiated an expiry review of its finding of injury made on December 9, 2013, concerning the dumping and subsidizing of Thermoelectric Containers originating in or exported from China. The order is scheduled to expire on December 8, 2018.
On October 31, 2018, as a result of the CITT’s expiry review, the Canada Border Services Agency (CBSA) initiated an expiry review investigation to determine whether the expiry of the above finding is likely to result in the continuation or resumption of dumping and/or subsidizing of the subject goods.
The CBSA will make a determination no later than March 29, 2019, and will issue a Statement of Reasons by April 12, 2019.
The subject goods are defined as thermoelectric containers that provide cooling and/or warming with the use of a passive heat sink and a thermoelectric module, excluding liquid dispensers, originating in/or exported from the People’s Republic of China. The exclusion of liquid dispensers from the definition is intended to exclude such products as water coolers, cream dispensers and milk dispensers.
These goods are normally imported under HS classification numbers 8418.29.00.00, 8418.50.10.00, 8418.50.29.00, 8418.61.00.00, 8418.69.90.80, 8418.69.90.90 & 8418.99.90.90. As part of its expiry review investigation, the CBSA has forwarded questionnaires to Canadian producers, importers, exporters and to the Government of China.
