Bien que le Mexique ait r\u00e9cemment adopt\u00e9 des lois en mati\u00e8re de r\u00e9forme du travail qui permettront aux travailleurs de voter au sujet des syndicats et de leurs contrats de travail par l\u2019interm\u00e9diaire de scrutins secrets, les d\u00e9mocrates maintiennent que les dispositions relatives \u00e0 l\u2019application des lois dans le cadre de l\u2019ACEUM sont insuffisantes et peu susceptibles de cr\u00e9er les conditions n\u00e9cessaires pour emp\u00eacher la fuite continue des emplois am\u00e9ricains vers le sud de la fronti\u00e8re. Les r\u00e9publicains maintiennent quant \u00e0 eux que les dispositions relatives au travail se situent un cran au-dessus de l\u2019AL\u00c9NA et qu\u2019elles repr\u00e9sentent la meilleure occasion possible pour faire en sorte que les responsables mexicains rendent des comptes (au niveau politique et financier).<\/p>\n<p>De m\u00eame, la Maison-Blanche maintient que les r\u00e8gles d\u2019origine pour le secteur de l\u2019automobile, s\u2019accompagnant d\u2019exigences beaucoup plus \u00e9lev\u00e9es pour l\u2019Am\u00e9rique du Nord, g\u00e9n\u00e9reront beaucoup plus d\u2019emplois que les 28 000 annonc\u00e9s dans le rapport de l\u2019U.S. International Trade Commission publi\u00e9 le mois dernier.<\/p>\n<p>Le r\u00e9sultat de l\u2019impasse est l\u2019ambigu\u00eft\u00e9 en cours au sujet du sort de l\u2019accord commercial en p\u00e9ril et, \u00e0 son tour, le sort du libre-\u00e9change en Am\u00e9rique du Nord.<\/p>\n<p>Bien qu\u2019il soit clair que ces consid\u00e9rations sont importantes et que la r\u00e9solution de cette impasse permettrait d\u2019assurer la long\u00e9vit\u00e9 de l\u2019ACEUM, la non-r\u00e9solution de cette impasse constitue un grand danger.<\/p>\n<h3><strong>Le libre-\u00e9change ne repose pas que sur l\u2019application des lois du travail et l\u2019emploi dans le secteur automobile<\/strong><\/h3>\n<p>L\u2019ACEUM repose sur beaucoup plus que la mise \u00e0 jour et l\u2019am\u00e9lioration des normes du travail, ou m\u00eame l\u2019affinement des r\u00e8gles d\u2019origine applicables aux automobiles nord-am\u00e9ricaines. Il s\u2019agit de l\u2019harmonisation massive d\u2019un accord commercial qui a solidifi\u00e9 la position de l\u2019Am\u00e9rique du Nord \u00e0 titre de bloc commercial le plus important au monde.<\/p>\n<p>Bien que des plaidoyers passionn\u00e9s aient \u00e9t\u00e9 pr\u00e9sent\u00e9s aux r\u00e9publicains et aux d\u00e9mocrates, les d\u00e9cideurs ne reconnaissent souvent pas l\u2019impact de l\u2019accord et du libre-\u00e9change en g\u00e9n\u00e9ral en ce qui concerne l\u2019\u00e9conomie des \u00c9tats-Unis au sens large.<\/p>\n<p>L\u2019importance du libre-\u00e9change pour l\u2019\u00e9conomie et les industries des \u00c9tats-Unis est un argument irr\u00e9futable pour ratifier l\u2019ACEUM et accro\u00eetre le libre-\u00e9change en Am\u00e9rique du Nord.<\/p>\n<p>Le Canada et le Mexique font partie des trois principaux march\u00e9s d\u2019exportation de 49 \u00e9tats am\u00e9ricains et tant le Canada que le Mexique sont les principaux partenaires commerciaux de 39 \u00e9tats am\u00e9ricains. Environ deux millions d\u2019emplois aux \u00c9tats-Unis sont soutenus par l\u2019exportation de produits manufactur\u00e9s vers le Canada et le Mexique seuls.<\/p>\n<p>Depuis que l\u2019AL\u00c9NA est entr\u00e9 en vigueur en 1993, les exportations des services am\u00e9ricains vers le Canada et le Mexique ont tripl\u00e9, passant de 27 milliards de dollars \u00e0 91 milliards de dollars. Les agriculteurs am\u00e9ricains d\u00e9pendent grandement de l\u2019acc\u00e8s aux march\u00e9s canadien et mexicain, le tiers des exportations agricoles \u00e9tant en effet destin\u00e9 \u00e0 leurs voisins du Sud et du Nord.<\/p>\n<p>Une grande partie de la prosp\u00e9rit\u00e9 engendr\u00e9e par le libre-\u00e9change en Am\u00e9rique du Nord a b\u00e9n\u00e9fici\u00e9 directement aux petites entreprises des \u00c9tats-Unis qui comptent le Canada et le Mexique parmi leurs deux principales destinations d\u2019exportation.<\/p>\n<h3><strong>Au-del\u00e0 des dispositions sur le travail et des r\u00e8gles d\u2019origine dans le secteur de l\u2019automobile<\/strong><\/h3>\n<p>Les donn\u00e9es susmentionn\u00e9es devraient constituer une raison suffisante pour faire de la ratification de l\u2019ACEUM une valeur s\u00fbre. Et pourtant, le nouvel accord a le potentiel d\u2019\u00e9largir davantage les activit\u00e9s commerciales \u00e0 l\u2019\u00e9chelle de l\u2019Am\u00e9rique du Nord et d\u2019offrir de r\u00e9els avantages aux entreprises et aux travailleurs am\u00e9ricains.<\/p>\n<p>Les protections des droits de propri\u00e9t\u00e9 intellectuelle prot\u00e9geront les producteurs contre les marchandises contrefaites et stimulera l\u2019activit\u00e9 dans les industries IP intensives, qui soutiennent actuellement 45,5 millions d\u2019emplois qui g\u00e9n\u00e8rent 6,6 trillions de dollars am\u00e9ricains du PIB am\u00e9ricain, selon l\u2019U.S. Chamber of Commerce.<\/p>\n<p>L\u2019accord all\u00e8ge \u00e9galement les formalit\u00e9s et propose des proc\u00e9dures r\u00e9glementaires \u00e9quitables et transparentes, permettant davantage aux petites entreprises am\u00e9ricaines de participer \u00e0 l\u2019importation et \u00e0 l\u2019exportation de marchandises.<\/p>\n<p>Et pendant que la croissance du commerce \u00e9lectronique et des produits num\u00e9riques entra\u00eene de nouveaux d\u00e9fis pour les agences en douane internationales et l\u2019Organisation mondiale des douanes en ce qui concerne l\u2019application ad\u00e9quate des droits, l\u2019ACEUM pr\u00e9sente de nouvelles dispositions relatives \u00e0 une \u00e9conomie num\u00e9rique qui contribuera \u00e0 s\u00e9curiser la circulation transfrontali\u00e8re des donn\u00e9es, interdira les droits de douane sur la transmission de produits \u00e9lectroniques tels que les livres num\u00e9riques, et veillera \u00e0 la collaboration continentale en mati\u00e8re de cybers\u00e9curit\u00e9.<\/p>\n<p>L\u2019ACEUM simplifie les proc\u00e9dures de douane, harmonise les politiques r\u00e9glementaires, promeut le commerce \u00e9lectronique, offre un plus grand acc\u00e8s au march\u00e9 laitier canadien et maintient des dispositions importantes en mati\u00e8re de r\u00e8glement des diff\u00e9rends dans le cadre des diff\u00e9rends entre pays.<\/p>\n<h3><strong>\u00c9largir le d\u00e9bat public au sujet de l\u2019ACEUM<\/strong><\/h3>\n<p>Les avantages pr\u00e9sent\u00e9s ci-dessus sont rarement mentionn\u00e9s dans le cadre du d\u00e9bat public au sujet de l\u2019ACEUM, qui s\u2019articule d\u00e9sormais de fa\u00e7on obsessive autour des provisions relatives \u00e0 l\u2019application des lois du travail. Ce qui ne veut pas dire que les dispositions ne sont pas importantes. En effet, le principal motif de ren\u00e9gociation de l\u2019AL\u00c9NA \u00e9tait d\u2019aplanir les disparit\u00e9s en ce qui a trait au travail, particuli\u00e8rement dans l\u2019industrie manufacturi\u00e8re.<\/p>\n<p>De la m\u00eame fa\u00e7on, il est important d\u2019examiner les modifications apport\u00e9es aux r\u00e8gles d\u2019origine dans le secteur de l\u2019automobile. Aucune autre industrie n\u2019a saisi les avantages de l\u2019AL\u00c9NA en ce qui a trait \u00e0 la cr\u00e9ation de cha\u00eenes d\u2019approvisionnement continentales int\u00e9gr\u00e9es comme l\u2019industrie automobile l\u2019a fait. Les modifications apport\u00e9es au mode de fonctionnement de ces cha\u00eenes d\u2019approvisionnement auront une incidence sur les mod\u00e8les de production et de distribution, ainsi que sur les tendances de l\u2019emploi et de la consommation.<\/p>\n<p>Il est essentiel de discuter de ces enjeux. Il est toutefois tout aussi important de veiller \u00e0 ce que les nombreuses autres vastes r\u00e9formes pr\u00e9sent\u00e9es dans l\u2019ACEUM ne soient pas perdues ou \u00e9clips\u00e9es dans le cadre de ce d\u00e9bat.
