Do you manufacture or import products that may contain mercury such as fluorescent lamps or tubes, light bulbs, neon lights, thermometers, thermostats, switches, dental amalgam, batteries and others. Many mercury containing products are already subject to other federal regulatory controls and the Products containing Mercury Regulations may not apply. Environment Canada advises of the following details and information on the regulations, labeling and reporting requirements.
As of November 8, 2015, the Products Containing Mercury Regulations are prohibiting the import and manufacture of products containing mercury and its compounds.
Exemptions to the prohibition do exist when meeting certain conditions, including total mercury content, or certain essential products with no current technical or economically viable alternatives. However, for those products exempt from the prohibition, labelling, reporting and record keeping requirements may still apply.
To assist you in understanding the implications of the Regulations to your import business, we have attached an information sheet summarizing the key requirements of the Regulations. Please consult the Regulations for product-specific requirements here.
We have also enclosed Form which we would appreciate your assistance in completing. While you are under no regulatory obligation to complete this particular form, confirming your contact and product information will be beneficial to you and your business: it enables us to communicate compliance information tailored to your products and business needs, such as reminders of specific exemption deadlines, record keeping and reporting deadlines. We will also be able to keep you informed and engaged in future developments and changes to the Regulations.
