On December 15th, the Secretariat of Economy (SE) published in the Federal Official Gazette (DOF), the update of the format of the certificate of origin and its respective filling instructions that the competent authority will have to validate more expeditiously, with the purpose of facilitating the exchange, trade between both countries.
In this regard, the following information stands out:
- Valid certificates of origin that have been issued prior to the effective date of this Decision will continue to be valid during the term of its validity.
- This Decision shall enter into force 60 days after the date on which the Parties notify in writing that they have completed their respective internal operating procedures. As of the effective date of this Decision, the format of the certificate of origin and its respective instructions for filling in this approved act will replace those previously adopted by the Parties.
- The Parties may issue during a period of 90 days after the entry into force of this Decision, certificates of origin with the previous format, which will continue to be valid during the term of its validity.
Likewise, Annex 1 was released, which contains the updates to the certificate of origin, as well as the INSTRUCTION FOR THE FILLING OF THE CERTIFICATE OF ORIGIN, it is reported that, in order to receive preferential tariff treatment, this document must be duly Completed in its entirety, including Field No. 3 or No. 10, when applicable, legibly and signed by the exporter of the good and the importer must have it in his possession at the time of formulating the import request.
Moreover, when the exporter is not the producer of the good, he must fill out and sign this document based on a declaration of origin that covers the good, filled out and signed by the producer of the good. Please type or print. The certificate may not include erasures, corrections or amendments.
This Agreement will enter into force on December 18, 2020.
