On November 30th, the Secretariat of Economy announced 4 official letters related to NOMs application criteria:
1) Application criteria to “Spare parts” for NOM-050-SCFI-2004, “Commercial information-general labeling of products.” In this office, it is highlighted in point 2.2 of NOM-050-SCFI- 2004 subsection e), that this will not be applicable to spare parts or spare parts that are acquired through catalogs and identified with a part number or code, according to their brand and model, intended solely to provide service or repair products.
The field of application of the NOM corresponds to the commercial information of packaged products destined for the final consumer, which allows a better purchase option.
Considering that the spare parts acquired through catalogs are products intended to provide service or repair equipment and therefore are not intended to be displayed at a point of sale to be acquired by the final recipient, so this NOM is not applicable to those products. Spare parts or spare parts are those products that are acquired through a catalog, which are used to provide service or maintenance, such as: forklifts, platforms, construction equipment, centrifugal pumps, hardware, among others.
2) The second official letter establishes that the field of application of NOM-186-SSA1 / SCFI-2013 is cocoa, chocolates and similar products and cocoa derivatives that are going to be commercialized in the national territory, destined for the final consumer.
For greater clarity, it is mentioned that the raw material, inputs, which are used for a production or manufacturing process, transformation to obtain other food products, such as, for example: cakes, cookies, ice cream, are not intended for the final consumer among others.
3) The third official notice indicates that the purpose of NOM-051-SCFI / SSA1-2010, lies in establishing the commercial and health information that the product labeling must contain relative to prepackaged food and non-alcoholic beverages destined for the final consumer, of national or foreign manufacture, marketed in national territory, as well as determining the characteristics of said information and establishing a front labeling system, which must clearly and truthfully warn about its content of critical nutrients and ingredients that represent health risks.
In this regard, the field of application of the NOM-051-SCFI / SSA1-2010, are prepackaged foods and non-alcoholic beverages destined for the final consumer, leaving out of it, food supplements.
4) The fourth criterion is intended to define which goods imported as textile products are subject to compliance with NOM-004-SCFI-2006. In this sense, it is established that textiles, home clothes and clothing and their accessories correspond to manufactured, made or imported products, that is, to final products destined for the final consumer that are marketed within the territory of USA, and either to cover the body, or they are functional products such as curtains, towels, rugs and which in turn are made up of natural, synthetic and / or artificial fibers.
The above, unlike textile products that are not intended for the final consumer, such as textile cords, belts, textile badge holder straps, badge holders, fabric waste, disposable clothing, non-woven fabric, uncut fabric , mutilated or chopped rags, among others, are excluded from the object and field of application of the aforementioned NOM, since given their application they are not available to the final consumer at the point of sale to be acquired or consumed.
