On October 25, 2018, the Canada Border Services Agency (CBSA) began assessing a 25% Surtax on the importation of seven classes of steel goods that exceed the tariff rate quota (TRQ) for each class of goods as specified in Order, 2018-1275, “Order Referring to the Canadian International Trade Tribunal, for Inquiry into and Reporting on, the Matter of the Importation of Certain Steel Goods.”
On November 28, 2018, the Canadian International Trade Tribunal (CITT) issued a revised notice of the Commencement of the Safeguard Inquiry to publish an updated inquiry schedule, and information.
Also on this date the CITT published multiple reports and orders relating to the recently imposed Safeguard Measures.
One report provides a Steel Safeguard Inquiry and Industry Overview as well as a statistical summary.
The other seven reports further describe each of the seven classes of steel goods named under the order and include a summary of details and statistics on imports, markets, values, performance indicators of domestic producers and other factors. Each report is dedicated to one of the seven steel products named in the order, including energy tubular, heavy plate, hot-rolled sheet, pre-painted steel, concrete reinforcing bar, wire rod, and stainless steel wire.
Additional orders published on this date named specific importers obligated to deliver to the CITT, a certified Importer’s Questionnaire concerning the importation of goods named in the order.
Importers of steel products subject to the TRQ or Provisional Safeguard Surtax on Steel Products are encouraged to review the revised notice of the Commencement of the Safeguard Inquiry for changes in deadlines, hearings dates and opportunities to present final arguments in writing.
Parties wishing to raise any procedural or preliminary matters are to do so, in writing, no later than December 28, 2018
